General Statement This Privacy Policy (“Privacy Policy”) discloses the privacy practices for i-mate (“imate”) with regard to your use of this website (www.imate.com and all imate subdomains, the “Site”). imate is committed to your privacy. imate hereby notifies you of: What personally identifiable information of yours is collected from you through this Site and how the information is used.
imate is the sole owner of the information collected on this Site. imate will not sell, share, transfer or rent this information to others in ways different from what is disclosed in this Privacy Policy. imate collects information from you on certain pages on this Site. b. Registration imate collects personal identifying information regarding its customers, including information customers give imate, information collected as a result of the customer's relationship with imate and information it obtain from other sources. Examples include name; address; e-mail address; telephone number; billing, payment, usage, credit and transaction information (including credit card numbers, account numbers and/or social security number). imate also collects personal identifying information that its Web visitors choose to provide to (e.g., name, address, telephone number, e-mail address) when registering on its Web sites; ordering imate products or services; sending us e-mail; responding to our surveys; entering contests or sweepstakes; posting submission to this Site, or in connection with online ordering or billing functions. imate uses the personal identifying information of a customer to provide, confirm, change, bill, monitor and resolve problems with the quality of imate products and services. imate also uses the personal identifying information of a customer or Web visitor to develop, market and sell our products and services. imate may aggregate the personal identifying information of different customers or Web visitors to produce data about a group or category of services, customers or Web visitors. For example, it might use aggregate data about the types of services our customers have generally purchased at the same time in order to develop attractive bundled service offerings. Such aggregate data, however, will not reflect any personal identifying information of any specific customer or Web visitor. c. IP Addresses When Web visitors access the Site, imate automatically receives certain "Web usage" information. For example, the Site automatically collects the visitor's IP address, the visitor's Web browser and operating system types, and the identity of the Web page from which the visitor's browser entered our Web site. In addition, primarily through the use of cookies or Web beacons, imate may collect other Web usage information, such as the Web pages the browser visits on our Web sites, the amount of time spent on such Web pages and whether the browser re-visits our Web sites/pages. imate uses Web usage information to facilitate and enable the functioning of the Site and to expand and improve its Web visitors' online experience. imate may also aggregate such Web usage information with other visitors' Web usage information to assess trends and better design, monitor and otherwise improve the Site, as well as to focus its marketing efforts. In some cases imate may combine Web usage information related to the access to the Site with personal identifying information. imate uses the combined information to provide its customers and Web visitors with a better online experience by providing customized features and services and to market and provide advertising about goods and services that may be of particular interest. Once combined, the resulting data is protected as personal identifying information as described in this policy. d. Children’s and Minor’s Privacy imate’s website is not designed to attract children under the age of 13. imate does not target children for the collection of information online and do not knowingly collect personal identifying information from anyone under the age of 18. Ordering online products and services from imate is limited to adults (age 18 or over or as otherwise legally defined). imate complies with all applicable laws and regulations, including the Children's Online Privacy Protection Act (COPPA), which requires the consent of a parent or guardian for the collection of personally identifiable information from children under 13. e. Opt Out Procedures You may opt-out of receiving communications from imate at the point where the Site requests personally identifiable information about you. To be removed from an e-mail list, contact policy@imate.com or follow the instructions contained in any e-mail correspondence that you receive from imate. To unsubscribe from a third party service, you must contact that third party directly. f. Cookies A cookie is a small piece of data that is sent to your browser from a Web server and stored on your computer’s hard drive. A cookie cannot read data off your hard disk or read cookie files created by other sites. Use of a cookie is in no way linked to any personally identifiable information while on the Site. Some of imate’s business partners may use cookies on the Site. However, imate has no access to or control over these cookies. imate and its business partners may use cookies to better personalize the content, banners, and/or promotions that you see on the Site. You can choose whether to accept cookies by changing the setting of your browser. You can reset your Browser to refuse all cookies or allow your browser to show you when a cookie is being sent. If you reject the cookies on the Site, you may still use the Site, but will not be able to log in, which will limit you to areas of the site that do not require a logged in account. How Information May Be Shared. a. Sharing imate may share aggregated demographic information. This is not linked to any personal information that can identify any individual person. imate does not share personally identifiable information with third parties. To the extent that your credit card information is collected by imate or any of its affiliates or subsidiaries, such information will be kept in confidence and will not be shared with any third parties (other than consumer credit agencies) without your prior consent. imate shall not be liable for the transfer or disclosure of any personal identification information resulting from loss or distribution of data, the delineation or corruption of storage media, power failures, natural phenomena, riots, acts of vandalism, sabotage, terrorism or any other event beyond imate’s control. b. Sale of Assets, Merger, Acquisition, Bankruptcy Information collected from you may be transferred to a third party as a result of a sale, merger or corporate transfer involving imate. c. Spam Notwithstanding anything to the contrary herein, imate maintains a strict “No-Spam” policy, which means that imate will not sell, rent or otherwise give your e-mail address to a third party without your consent. d. Legal Requests imate cooperates with law enforcement inquiries, as well as other third parties, to enforce laws and third party rights, such as intellectual property rights and laws relating to fraud. imate can (and you authorize imate to) disclose your personal data and other information about you as imate, in its sole discretion, believes necessary or appropriate to comply with properly authorized civil, criminal or regulatory investigations or subpoenas or summons’ issued by governmental authorities. e. User Submissions imate offers group pages, Site pages, message boards, blogs or the like (collectively, “Forums”) for you in a number of areas throughout the imate Site. The Forums are currently hosted by imate. Any information you disclose when posting to a Forum, along with your screen name or ID, becomes public as soon as they are published online and may be used by imate for online and offline promotional or commercial uses in any and all media. Confidentiality and Security When imate requests that you enter sensitive information, imate encrypts such information with encryption software. imate also protects your personal information off-line. Access to your personal information is limited to employees who imate reasonably believes will need that information to provide services to you. However, imate is not responsible for the confidentiality, security or distribution of your own personal information by our partners and third parties outside the scope of our agreement with such partners and third parties. b. Links This Site may contain links to other sites. The linked sites are not necessarily under the control of imate. Please be aware that imate is not responsible for the privacy practices of such other sites. imate encourages you to be aware when you leave this Site and to read the privacy policies of each and every website that collects personally identifiable information. If you decide to access any of the third party sites linked to this Site, you do this entirely at your own risk. Any links to any partner of the Site are the responsibility of the linking party, and imate shall not be responsible for notification of any change in name or location of any information on the Site. CORRECTING INACCURACIES. a. Correcting/Updating Personal Information If personally identifiable information previously submitted to imate by you changes (such as name, e-mail address, telephone number, fax number, information about your interests in and use of various products, programs, and services, educational level and interests and/or billing information), you can update your profile at https://www.imate.com/mat-myprofile.aspx on the Site. b. Notification of Changes If imate decides to change the Privacy Policy for this Site, imate will post those changes on www.imate.com. All changes are effective immediately upon posting. c. Site and Service Updates As necessary, imate may send you Site and service announcement updates. You are not able to unsubscribe from service announcements, which contain important information about the Site. imate communicates via e-mail with you to provide requested services and to resolve issues relating to your accounts. d.
